1. Introduction

Welcome to EVE. These Terms of Use ("Terms") are a legal agreement between you and EVE INC. ("EVE," "we," "us," or "our"), a company registered in Ontario, Canada. These Terms govern your access to and use of our mobile application, websites, and related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services. For questions, contact us at info@evephuket.com.

2. Eligibility

To use EVE, you must be at least the age of majority in your jurisdiction and have the legal capacity to enter into a binding agreement. By using the Services, you represent and warrant that you meet these requirements.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms or for any reason at our sole discretion.

4. Services Description

EVE provides a platform for event discovery, venue exploration, and social interaction. Please note:

  • Event listings and venue information are provided for informational purposes; accuracy is not guaranteed
  • Many events listed on EVE are organized by third parties, not by EVE
  • We do not guarantee any specific results, outcomes, or experiences from using the Services

5. User Conduct

When using EVE, you agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Infringe on intellectual property rights of EVE or any third party
  • Disrupt, interfere with, or attempt to compromise the platform's functionality or security
  • Post or transmit harmful, offensive, threatening, defamatory, or otherwise objectionable content
  • Impersonate any person or entity, or misrepresent your affiliation
  • Collect, harvest, or scrape user data without authorization

6. User Content

Definition

"User Content" refers to any text, images, reviews, comments, photos, or other materials you post, upload, or submit through the Services.

License Grant

By submitting User Content, you grant EVE a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from your User Content in connection with operating and promoting the Services.

Responsibility

You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to submit such content and that it does not violate any third-party rights or applicable laws.

7. Intellectual Property

All content, features, and functionality of the Services (including but not limited to text, graphics, logos, icons, images, software, and design) are owned by EVE INC. or its licensors and are protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. You may not:

  • Copy, modify, or distribute any part of the Services without our written consent
  • Reverse engineer, decompile, or disassemble any software used in the Services
  • Use the EVE name, logo, or branding without prior written authorization

8. Payment and Refunds

Certain features or events on EVE may require payment. By making a purchase, you agree to the following:

  • Payments are processed through third-party payment processors; we do not store your full payment information
  • Prices are subject to change without prior notice
  • Refund policies vary by event organizer; EVE is not responsible for refunds on third-party events unless otherwise stated

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. EVE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • EVE shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services
  • Our aggregate liability for any claims arising from the Services shall not exceed the greater of one hundred Canadian dollars (CAD $100) or the total amount you have paid to EVE in the twelve (12) months preceding the claim

11. Indemnification

You agree to indemnify, defend, and hold harmless EVE INC., its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your User Content

12. Modification and Termination

Services

We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice.

Your Account

You may terminate your account at any time by contacting us. We may also terminate or suspend your account if you violate these Terms or for any other reason at our sole discretion.

13. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

  • Arbitration: Any disputes arising from these Terms or the Services may, at the election of either party, be resolved through binding arbitration in Ontario, Canada
  • Class action waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration

14. International Users

EVE is based in Canada and our Services are primarily operated from Canada and Thailand. If you access the Services from outside these countries, you do so at your own risk and are responsible for compliance with local laws in your jurisdiction.

15. Changes to These Terms

We may modify these Terms at any time by posting the revised version on our platform. We will update the "Last Updated" date at the top of this page. Your continued use of the Services after changes are posted constitutes your acceptance of the modified Terms.
