Terms of Use
The agreement that governs your use of the EVE app and website. Please read it carefully. By using EVE, you accept these Terms, our Privacy Policy, and our Community Guidelines.

1. Introduction
Welcome to EVE. These Terms of Use ("Terms") form a legal agreement between you and EVE INC. ("EVE," "we," "us," or "our"), a company incorporated in Ontario, Canada, with operations in Phuket, Thailand. They govern your access to and use of our mobile application, our website (evephuket.com), and related services (the "Services").
By accessing or using the Services, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines, which are incorporated by reference. If you do not agree, you must not use the Services. Questions: [email protected].
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, and have the legal capacity to enter into a binding agreement. By using the Services, you represent and warrant that you meet these requirements. EVE is not intended for and may not be used by minors.
3. What EVE Is (and Is Not)
EVE is a discovery platform that helps people find events, venues, and experiences in Phuket, and helps businesses and organizers reach an audience. It is important to understand what we are not:
- EVE is not the organizer, promoter, host, employer, ticketing agent, or booking agent for events listed on the platform, unless we expressly state otherwise
- Events and venues are operated by third parties who are solely responsible for them, including accuracy, legality, safety, pricing, and fulfillment
- Event and venue information is provided for general information; we do not guarantee its accuracy, completeness, or availability
- You attend events and visit venues at your own risk, and your dealings with third-party organizers and venues are solely between you and them
4. Account Registration and Security
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Keep your account credentials confidential and secure
- Notify us immediately of any unauthorized use of your account
You are responsible for all activity under your account. You may sign in using third-party providers (such as Google, Facebook, or Apple); your use of those providers is also governed by their terms.
5. Acceptable Use
Your use of EVE must follow our Community Guidelines. Without limiting them, you agree not to:
- Violate any applicable law, regulation, or third-party right
- Post unlawful, harmful, harassing, hateful, defamatory, deceptive, or otherwise objectionable content
- Post fake, incentivized, or misleading reviews or ratings
- Infringe the intellectual property rights of EVE or any third party
- Impersonate any person or entity or misrepresent your affiliation
- Interfere with, disrupt, or attempt to compromise the platform's security or functionality
No scraping or automated harvesting. You may not use bots, crawlers, scrapers, or other automated means to access, copy, collect, or harvest data, listings, reviews, or content from the Services, or to overload our infrastructure, without our prior written permission. Our venue, event, and user data is proprietary, and unauthorized automated collection is a material breach of these Terms.
6. Your Content
Definition
"User Content" means any text, images, reviews, comments, photos, or other materials you post, upload, or submit through the Services.
License you grant us
You retain ownership of your User Content. By submitting it, you grant EVE a non-exclusive, royalty-free, worldwide, transferable, sub-licensable license to host, store, use, reproduce, modify, adapt, publish, display, and distribute that content for the purpose of operating, improving, and promoting the Services. This license ends when you delete your User Content or your account, except for content others have shared, copies retained for legal or backup purposes, and de-identified or aggregated data.
Your responsibility
You are solely responsible for your User Content and represent that you own or have the rights to submit it and that it does not violate any law or third-party right.
7. EVE Intellectual Property
All content, features, and functionality of the Services (excluding User Content), including text, graphics, logos, icons, images, software, and design, are owned by EVE INC. or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes. You may not:
- Copy, modify, or distribute any part of the Services without our written consent
- Reverse engineer, decompile, or disassemble any software used in the Services
- Use the EVE name, logo, or branding without prior written authorization
8. Copyright Complaints and Takedown (DMCA)
We respect intellectual property rights and respond to clear notices of alleged copyright infringement. If you believe content on EVE infringes your copyright, send a notice to [email protected] including:
- Your physical or electronic signature
- Identification of the copyrighted work claimed to be infringed
- Identification of the allegedly infringing material and where it is located on EVE
- Your contact information (address, phone, email)
- A statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law
- A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf
We will remove or disable access to infringing material expeditiously and may notify the user who posted it, who may submit a counter-notice. We terminate the accounts of repeat infringers.
9. Payments, Tickets, and Refunds
EVE is free to browse and to list. Certain features, tickets, or promotions may require payment. Where they do:
- Payments are processed by third-party payment providers; we do not store full payment card details
- Prices may change without prior notice
- Tickets and bookings for third-party events are subject to the organizer's own refund and cancellation policy; EVE is not responsible for refunds on third-party events unless we expressly state otherwise
- For any paid feature sold directly by EVE, the applicable refund terms will be presented at the point of purchase
10. Mobile Applications and App Stores
If you download the EVE app from the Apple App Store or Google Play, your use is also subject to that store's terms. For the Apple App Store, you acknowledge that these Terms are between you and EVE, not Apple, and that Apple is not responsible for the app or its support; Apple and its subsidiaries are third-party beneficiaries entitled to enforce these Terms against you. Where we offer third-party sign-in, equivalent privacy-respecting sign-in options are provided as required by the app stores.
11. Suspension, Termination, and Account Deletion
You may delete your account and associated data at any time through the EVE app (Settings) or via our Account & Data Deletion page. We may suspend or terminate your account if you violate these Terms or the Community Guidelines, if required by law, or to protect the platform and its users. We may modify, suspend, or discontinue any part of the Services at any time, with notice where reasonably practicable.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. EVE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT EVENT AND VENUE INFORMATION IS ACCURATE OR COMPLETE.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- EVE is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or your dealings with any third-party organizer or venue
- Our total aggregate liability for any claim arising from the Services will not exceed the greater of one hundred Canadian dollars (CAD $100) or the amount you paid to EVE in the twelve (12) months before the claim
Nothing in these Terms limits liability that cannot be limited under applicable law, including certain consumer-protection rights you may have in your jurisdiction.
14. Indemnification
You agree to indemnify and hold harmless EVE INC., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, your violation of any third-party right, or your User Content.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles, except where mandatory local consumer-protection law applies to you.

- Arbitration: any dispute may, at the election of either party, be resolved through binding arbitration in Ontario, Canada
- Class-action waiver: to the extent permitted by law, you agree to resolve disputes individually and waive participation in class actions or class-wide arbitration
16. International Users
EVE is operated from Canada and Thailand. If you access the Services from elsewhere, you do so on your own initiative and are responsible for compliance with local law.
17. Changes to These Terms
We may update these Terms from time to time. We will post the revised version here and update the "Last Updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms.
